Listing Policy
Identical Listings: You may not list more than 1 identical item in any more than 2 individual categories. This rule is in place to improve the user experience. Arma Auction offers Free Membership Free Unlimited listings Free Store (Excluding: Automotive, Marine and Real Estate theses will be charged a one time listing fee until sold with no final value fees feature fees or relisting fees) and we need to ensure that identical listings are not excessive and therefore abusing the FREE listing policy.
If you have a multiple quantity available, please enter the quantity available when listing the item. See Dutch Auction items in the help topic How To Sell for more information.
Items are considered identical based on such information as the title, pictures and description (including items with different variations). Although you may have added the different variations via your descriptions, subtitles or pictures, this will not be sufficient if your titles are exactly the same. Titles will need to be different, even by the addition of just the one differentiating word, such as 'Small', 'Medium' or 'Large'.
Where there are more than 5 items which appear to be duplicated (1 item with more than 5 variations in title, description or pictures), we require the variations to be clearly advertised within the item description instead of the title. We DO NOT ALLOW items with different variations to be listed with different titles more than 5 times. Only 1 listing will be allowed with a description outlining the variations.
Example: Let's say you sell Men's T-Shirts and have 10 colours and 3 sizes available. You are entitled to list 3 separate listings representing your items (Small, Medium and Large). The colours however, can ONLY be outlined within the description of each listing. Title: Men's T-Shirt Casual Wear BNWT Large
Description: Available in: RED, BLUE, GREEN, YELLOW, ORANGE, BLACK, WHITE, GREY etc.
Note: Misuse of this policy will result in your items being removed without a refund and or account suspension.
Arma Auctions Prohibited and Restricted Items
Arma Auctions reserves the right to remove any prohibited and restricted items including those not on this list if they are considered inappropriate, illegal or are in breach of our User Agreement.
You are responsible in making sure that you are legally allowed to buy or sell an item. Please find out before listing.
The following list is not intended to be an exhaustive statement of prohibited and restricted items.
Alcohol
You must have a licence to list wine and other alcohol on Arma Auctions and display your licence number in the listing. Make sure you know the laws of trading alcohol in all states you may trade in.
Animals, Animal Products, Organs or any Body Parts
You must not list any illegal animal/wildlife products or internal organs including human parts & remains can be released.
Artifacts and Heritage Items
You must not list any artifacts or heritage items on Arma Auctions.
Adult Related Items
Images or content which is adult or sexual related or inappropriate are Strictly Prohibited and not allowed on Arma Auctions. You must not list items that are considered to be indecent by the authorities or illegal to sell in Australia.
Copyright-infringing, Replica and Counterfeit Items
You must not list items or include content which breaches any copyright or other intellectual property rights. Unauthorized replicas and counterfeits are not allowed to be listed on Arma Auctions. If you are unsure if an item is genuine, do not list it on Arma Auctions. (Any product that bears a trade mark not owned by the manufacturer or used under the trade mark owner's licence, must not be listed.)
Downloadable Media
Items that can be downloaded (digital) can only be listed by sellers that own the intellectual property or are authorised to distribute the intellectual property by the intellectual property owner.
Drugs
You must not list any controlled prescription drugs both herbal or chemical on Arma Auctions.
Food
Food items listed on Arma Auctions must be sealed, have labels that meet Australian laws and show expiry dates. Perishable food items must not be listed unless they are offered as Pick-up only.
Fireworks
You must not list any fireworks on Arma Auctions.
Lock Picking Devices
You must not list any lock picking or lock smithing device on Arma Auctions.
Noxious Weeds
Before listing plants or seeds ensure you are aware and up-to-date with the current legislation for noxious weeds. Plants or seeds that are officially listed as a noxious weed must not be listed on Arma Auctions.
OEM Software
You must not list Original Equipment Manufacturer software (OEM) on Arma Auctions unless listed with the specified accompanying hardware.
Police and Emergency Services Related Items
You must not list official Police or Emergency services equipment related items on Arma Auctions Auctions regardless of origin (other countries). For example: uniforms and any official or recent issue equipment. Any Police or Emergency items listed must be obsolete and in no way resemble official or recent issue. You must state this fact in your item description.
Postage Stamps
Used and "washed" Australia Post postage stamps offered for sale, with the obvious intention that they will be re-used must not be listed on Arma Auctions. Any listing that offers the sale of "un cancelled stamps" must be accompanied by a clear warning which draws viewers attention to the provisions of section 471.5 of the Commonwealth Criminal Code. Radio Communications Devices
Mobile telephone jammers, GPS (Global Positioning System) jammers and mobile telephone boosters must not be listed on Arma Auctions. Jammers in particular are prohibited devices and cannot be sold or used within Australia. Any Radio communicating devices, including boosters must also comply with any applicable Australian standards in line with the Radio communications Act 1992. The holder / operator of such items may also need to be licensed / qualified prior to using certain frequency bands. Refer to the Australian Communications and Media Authority (ACMA) website for further details.
Real Estate
Real estate can be listed on Arma Auctions but due to the complicated laws governed by the sale of real estate, real estate items won on Arma Auctions are not legally binding. Sellers can list real estate as a way to advertise their real estate to potential buyers.
Software That Accesses Arma Auctions
You must not list software which directly or indirectly accesses Arma Auctions web site and database without approval by Arma Auctions.
Stolen Goods
Goods to which you are not the legal owner or which you are not otherwise legally entitled to sell must not be listed on Arma Auctions.
Tickets Over Face Value
Arma Auctions does not allow tickets to be re-sold beyond their face value (referred to as ticket scalping). To prevent tickets being sold over their face value they must be listed as "Buy Now Only" (instant purchase, no auction) items with a price below or equal to the face value.
Therapeutic Goods
Therapeutic goods, unless exempt, must be entered as either 'registered' or 'listed' goods when being listed on Arma Auctions. All listed medicines must display a "AUST L" number on the label. All registered medicines must display an "AUST R" number on the label as required by the Therapeutic Goods Administration (TGA).
Tobacco
You must not list tobacco which includes cigarettes, cigars, and smokeless tobacco on Arma Auctions. Tobacco related items may be allowed for sale.
Used Clothing
Clothing that has been used (with the exception of underwear and swimwear) may be listed. The item must be cleaned before sending.
Used Cosmetics
Used cosmetics must not be listed on Arma Auctions.
Weapons, Knives and Firearms
Weapons must not be listed on Arma Auctions with the exception of some knives/Swords. Knives/Swords must comply with current Australian laws. Firearms (including ammunition) with the exception of collectable/antique items (which have been rendered inoperable) cannot be listed on Arma Auctions.
General Terms.
This site acts as the window for sellers to conduct auctions and for bidders to bid on sellers' auctions. We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items listed the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on.
In addition, note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretence.
This Web-site shall not be responsible for any items sold by Auction, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. This web-site shall not be responsible for the cost of procurement of substitute goods or any losses resulting form any goods purchased or obtained.
This web-site assumes no liability for the content of the listings.
However if you fall victim of a fraudulent transaction we will assist you as much as we can.
Laws.
These Terms of Service shall be governed by and constructed in accordance with the laws of Australia and any disputes will be decided only by the Courts of Australia.
